Terms of Service (ToS)

This Hosting and Servers Terms of Service (“Terms of Service”) is by and between Code For Host, Inc and the customer who orders Code For Host’s cloud services (“you” or “Customer”).  These Terms of Service form part of an agreement (this/the “Agreement”) between Code For Host, Inc, and Customer.  The Agreement (as defined below) governs the provision of Code For Host, Inc’s Hosting services and the use of Code For Host, Inc’s service constitutes acceptance and agreement to Code For Host, Inc’s Terms of Service. By accepting the Agreement via electronic click-through authorization, Customer acknowledges that it has read and fully understands all of the terms and conditions set forth in the Agreement and hereby agrees to abide by the terms and conditions hereof.

The initial term for each Order begins on the date we make the Services available for your use and continues for the period stated in the Order.  If no period is stated in the Order, then the initial term shall be one month.  Upon expiration of the initial term, the Order will automatically renew for successive renewal terms of one month each, unless and until one of us gives the other a written notice of termination for convenience prior to the expiration of the initial term, or then-current renewal term, as applicable. If the services purchased are offered on an hourly basis your term will start when we make the Services available for your use and will continue until you delete them. You must follow Code For Host, Inc’s non-renewal process accessible from the Code For Host, Inc Cloud control panel to give an effective notice of non-renewal.

Suspension.  We may suspend your Services without liability if: (i) we reasonably believe that the Services are being used (or have been or will be used) in violation of the Agreement, (ii) we discover that you are, or are affiliated in any manner with, a person who has used similar services abusively in the past; (iii) you don’t cooperate with our reasonable investigation of any suspected violation of the Agreement; (iv) we reasonably believe that your Services have been accessed or manipulated by a third party without your consent, (v) we reasonably believe that suspension of the Services is necessary to protect our network or our other customers, (vi) a payment for the Services is overdue, or (vii) suspension is required by law.  We will give you reasonable advance notice of a suspension under this paragraph and a chance to cure the grounds on which the suspension is based, unless we determine, in our reasonable commercial judgment, that a suspension on shorter or contemporaneous notice is necessary to protect Code For Host, Inc or its other customers from imminent and significant operational or security risk.

Over usage: Per GB Disk space over usage fee $1/m, Per 10 GB Bandwidth over usage fee $2/m. And we count our storage & bandwidth with the latest unit of measure 1000MB to 1GB.

Free Domain: The free domain offer must be claimed at the time of hosting purchase, it cannot be purchased later. And the free domain will be set as the primary domain of the hosting. So the free migration benefit will then become unavailable for this service. Also, If you want to change your hosting primary domain name you must ensure you haven’t taken a free domain with your hosting pack. If you take a free domain with your hosting, you can’t change it before the next renewal date.

Termination:  On shared hosting, We give 15 days after the due date for hosting account termination. After that, your hosting account will be terminated. For VPS/Dedicated servers, there are no grace period, this mean the server will be terminated just after the expiration date. But BDIX VPS/Dedicated users may get upto 5 days after the expire date. After the termination, all data will be deleted parmanently and no backup is possible after that. So, if you do not want to continue the hosting service, but you want to keep your data, then please take a backup of your necessary data before the expire date. If a refund is asked for any service, we force-terminate the service and then we issue the refund. So, if you want to keep your data, you must take your data backup before asking a refund.

Hosting Reactivation: No extra fee is required to reactivate the account after hosting termination, unless it requires old data, we can restore the data within 7 days of termination in case of an advance pack, but in this case, you have to pay an extra fee. Which is 10 dollars in case of 1-5 GB pack, 20 dollars in case of 10-20 GB pack, and 30 dollars in case of 50 to 100 GB storage pack.

Data Transfer/Migration: Free transfer only applicable for cPanel to cPanel, Plesk to Plesk, and DirectAdmin to DirectAdmin transfer. For any manual transfer, the charge is $5-10/one time, based on Data size. For more information please check the transfer policy.

We will transfer up to 30 accounts free of charge for the Reseller. Each account thereafter is charged at $1 each.

For VPS or Dedicated Server, the root-to-root transfer is free and there is no account transfer limit. Non Root to Root transfer limit is 30 accounts, thereafter is charged at $1 each

No High-Risk Use.  You may not use the Services in any situation where failure or fault of the Services could lead to death or serious bodily injury of any person, or to physical or environmental damage.  For example, you may not use or permit any other person to use, the Services in connection with aircraft or other modes of human mass transportation, nuclear or chemical facilities, or Class III medical devices under the Federal Food, Drug and Cosmetic Act.

Data Backup: Hostever offers daily backups (up to previous 7 days) with Advance packs only. The backup is captured once per day. And in advance hosting, we take remote backups of your all data except for email only.
Notable that for any physical damage, or unexpected hardware failure, or for any other accidental case, Hostever do not ensure full data protection security with services. For such cases, we recommended to use your own remote backup management.

Database limits: We have no limit on creating databases. And we don’t have a problem with spending full space with the database. But every single database can never be above 1 GB. We suggest that it is not above 500 MB. However, in some cases, we are allowed to keep 1 GB, if it does not affect the server. But even in that case, the single table size cannot be above 250 MB. With this limit, you can create as many databases as you want in shared hosting.

Mail sending limit: We give up to unlimited email account creation option & there are no limits in receiving mail, but We strictly do limitations in mail sending which one is hourly 5 in basic pack & 20 for the advance pack, also daily max 20 for basic pack & 50-100 for the advance pack. Because we don’t allow spamming/abuse & also note that it’s a web hosting, not mail hosting. We strongly suggest to use a mail exchanger or our business email to use professionally.

Unlimited Resource: We all have to remember one thing, there is nothing unlimited in the world, here unlimited is said to mean that usually we will not notice if it does not go to the abuse level. For example, suppose you have been given the feature of adding unlimited subdomains, there you have done 50-100, we are not facing any problem on our server, in this case we will not tell you anything. Did 500+ again, because of this the server is having problems, even if we don’t want to at that time, we have to suspend you and keep the rest of my users active. Remember, a shared server has 200-220 users. Just as you do not accept another user’s site to be down, in the same way other customers of the server will not accept their site to be down for you, so everyone’s responsibility here is to keep the environment normal. And if someone needs a different environment, there is VPS/Dedicated Server. Note, Here resource means email, addon, subdomain, database, bandwidth, etc.

Inode or File uses Limitation: Currently, there are no file limits for advance Shared Hosting packs, VPS and Dedicated servers. This means you can use full of your allocated storage with limitless files without any interruptions.
But there are some limits for budget/basic pack users. As we explained that budget pack’s servers have come with bit low resources, so there are some limitations.

However, we don’t set any inodes (file) limit with our Advance Packs, but to keep the server performance normal, here are some limits you have to maintain. Otherwise, if any issue occurs with the server performance, initially we will disable your data backup and will give you time to fix the issue from your site. But if you are unable to solve your file/data issue or unable to decrease your file/data, then you must upgrade your pack to VPS or Dedicated server. Those limits are: (1) There will not more that 20k file or 5GB data in a single folder. (2) If you have equal to or more than 500k files or 25GB data, your backup schedule may change to weekly or disabled, and also we may suspend the account to keep the server normal. For resellers, we provide a 500k maximum per account when it goes to the abuse level but no limit in total reseller accounts.

For example, when an account has hundreds of thousands of files, it significantly degrades overall disk performance, as each file on the disk must be tracked/indexed. An easy analogy would be a table of contents or glossary for a book. If the book only has a few hundred pages, the index or glossary is likely to be small, and easy to search. If the book has 5,000 pages, finding what you want might take significantly longer. The file system on a server works in a similar way, just on a larger scale. The size of the file does not matter, only the size. For example, a DVD image (say, 4.5gb) only counts as one inode or file.
So, there are some file limits to keep the server performance well and to prevent abuse. The limit is given below:
